Welcome to Clearpoint Pool Services. By accessing our website or purchasing products from our online store, you agree to these Terms & Conditions. If you do not agree, please do not use the Website.

1. Eligibility

To purchase from our Website, you must:

• Be 18 years or older, or have the consent of a parent or legal guardian.
• Provide accurate and complete information when placing an order.
• Be authorised to use the payment method provided.

2. Products & Pricing

We make every effort to ensure product descriptions, images, specifications and pricing are accurate and up to date. However, errors may occasionally occur, and we reserve the right to correct them.

• All prices are in AUD and include applicable taxes unless stated otherwise.
• Delivery charges are calculated at checkout where applicable.
• Product availability may change without notice.
• We may limit quantities or discontinue products where necessary.

3. Orders & Payment

An order is accepted once we send you an order confirmation. We reserve the right to decline or cancel an order where necessary.

Payment must be made using an authorised payment method through our available payment providers.

Orders may be cancelled before dispatch by contacting us. Once an order has been dispatched, cancellation may no longer be possible.

4. Shipping & Delivery

We use a range of delivery services depending on the product and destination.

• Standard items: Most orders are shipped via Australia Post eParcel with tracking.
• Large items: Products such as sand filters may be delivered by dedicated courier.
• Daisy Pool Covers & Rollers: Manufactured in Welshpool and shipped directly from Daisy. Production generally takes 2–3 business days, plus delivery time.

Delivery Areas

• WA postcodes up to 6699: Free delivery on orders of $99 or more. A $19 delivery fee applies to orders under $99.
• Postcodes 6700 and above: A $35 delivery fee applies.
• Daisy Pool Covers & Rollers: $35 flat rate delivery across WA.
• Bulky, remote and special-order items: Additional charges and delivery times may apply and will be confirmed at checkout.

Orders placed before 2:30 PM AWST are generally dispatched the same business day, subject to stock availability.

Safe Drop

Orders are normally delivered with a signature requirement. If you request or select a safe drop option, you accept responsibility for the parcel once it has been delivered without a signature, subject to your rights under applicable law.

5. Returns & Refunds

Returns are subject to our Purchase Policy.

Change-of-mind returns may be accepted within 30 days of purchase and may incur a 30% restocking fee, provided the product is unused, in original condition and packaging, and meets our return requirements.

Faulty or defective products will be handled in accordance with applicable Australian Consumer Law.

6. Warranty

Some products are covered by a manufacturer’s warranty. Warranty terms vary by product and manufacturer.

Nothing in these Terms limits any rights or remedies you may have under Australian Consumer Law.

7. Limitation of Liability

To the extent permitted by law, Clearpoint Pool Services is not liable for indirect, incidental or consequential loss arising from the use of our Website or products.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded under Australian Consumer Law.

8. User Conduct

You agree not to:

• Use the Website for unlawful purposes.
• Interfere with the Website’s operation or security.
• Provide false, misleading or fraudulent information.
• Attempt to gain unauthorised access to our systems or accounts.

9. Intellectual Property

All content on the Website, including text, images, graphics, logos and other materials, is owned by or licensed to Clearpoint Pool Services unless otherwise stated.

You must not reproduce, modify or distribute our content without prior written permission, except where permitted by law.

11. Governing Law

These Terms are governed by the laws applicable in Western Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia and Australia, as applicable.
